Terms of Service

1. Acceptance of Terms

By accessing or using hrvstr ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. hrvstr is operated by hrvstr, Inc. ("we," "us," or "our").

2. Description of Service

hrvstr provides AI-powered tools for job seekers, including:

  • Resume tailoring and optimization
  • Cover letter generation
  • Job application tracking
  • Fit analysis and scoring
  • Interview preparation tools
  • Chrome browser extension for job saving

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update your account information if it changes
  • Accept responsibility for all activities under your account

You must be at least 18 years old to create an account and use the Service.

4. Subscription Plans and Billing

4.1 Free and Paid Plans

hrvstr offers both free and paid subscription plans. Features and usage limits vary by plan. Current pricing and features are available at hrvstr.net/pricing.

4.2 Billing

Paid subscriptions are billed monthly in advance. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel. Prices are in US dollars unless otherwise stated.

4.3 Cancellation

You may cancel your subscription at any time from your account settings. Your subscription will remain active until the end of your current billing period. After cancellation, you will be moved to the Free plan. Your existing jobs and documents will remain accessible but not editable.

4.4 Refunds

We do not offer refunds. All subscription fees are non-refundable. You may cancel your subscription at any time, but you will not receive a refund for any unused portion of your billing period.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Submit false or misleading information
  • Impersonate another person or entity
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated means to access the Service without permission
  • Resell or redistribute the Service without authorization
  • Use the Service to generate content that is deceptive, fraudulent, or harmful

6. User Content

6.1 Your Content

You retain ownership of content you upload to the Service, including your resume, work history, and personal information ("User Content"). By using the Service, you grant us a limited license to process your User Content solely for the purpose of providing the Service.

6.2 Generated Content

Documents generated by our AI (tailored resumes, cover letters, etc.) are created for your personal use in job applications. You are responsible for reviewing and verifying the accuracy of all generated content before use.

6.3 Accuracy

You are responsible for ensuring that all information in your documents is accurate and truthful. hrvstr does not verify the accuracy of information you provide or content generated based on that information.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by hrvstr, Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without permission.

8. AI and Machine Learning

Our Service uses artificial intelligence and machine learning to generate content. You acknowledge that:

  • AI-generated content may not always be perfect or accurate
  • You should review all generated content before use
  • We continuously improve our AI systems, which may change outputs
  • Generated content is based on your inputs and publicly available information

9. Third-Party Services

The Service may integrate with third-party services (e.g., job boards, payment processors, authentication providers). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE THAT USING OUR SERVICE WILL RESULT IN JOB OFFERS OR INTERVIEWS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPLYKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless hrvstr and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will cease immediately. You may request deletion of your data as described in our Privacy Policy.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
